Rules and ethics

UK rules for an announcement, mapped route by route from claims to supplier contracts

Map UK rules for an England announcement across claims, paid control, contact data, rights, security, corrections and supplier contracts carefully.

There is no single UK statute called the press release distribution law. An announcement can instead touch consumer protection, advertising codes, sector rules, data protection, electronic marketing, intellectual property, defamation, confidentiality, accessibility, security and contract. Which lane applies depends on the words, people, route and commercial arrangement, not on the document being labelled a press release.

This England-operating organisation guide's source cut-off was 6 September 2026, and most cited privacy, advertising and consumer material is UK-wide. The Defamation Act 2013 is mainly an England and Wales statute, though some cited accessibility guidance was written for government communications.

Territorial and material limits matter; this editorial control system is not legal advice or a compliance statement for any announcement.

What to take away

  • A press release label does not decide which UK rules apply; the words, people, route and commercial arrangement do.
  • A delivery receipt proves transmission only, not coverage, reach or reputation, so keep those records separate.
  • Every objective claim needs a dated primary record, and omissions can mislead as much as positive statements.
  • Publicly available contact data is not automatic consent to direct marketing, so map each contact before outreach.
  • Commissioning creative work does not automatically transfer copyright, so record the owner, licence and territory.

Start by naming the communication state

An approval sheet should say exactly what the buyer intends to do. Six activities commonly sit beside one another but create different evidence:

Technical transmission
Submission to contracted endpoints
Paid placement
Space or distribution bought under stated terms
Monitoring

What the record cannot prove

Buyer newsroom
That anybody discovered or trusted it
Direct outreach
Attention, consent to later marketing or publication
Technical transmission
Syndication, indexing, readership or editorial selection
Paid placement
Independent editorial endorsement
Monitoring
Complete coverage or public response
Independent publication
Buyer control over wording, permanence or audience effect

A delivery receipt should therefore stay a delivery receipt. It must not be renamed coverage, reach or reputation. The same boundary applies after publication: indexing, reading, referral traffic and a commercial decision are separate events requiring separate evidence.

Build a route-specific law map

The decision owner first records the legal entity making the statement, the products or conduct discussed, the intended recipients, the jurisdictions reached and whether money or another commercial benefit controls placement. From that record, a qualified reviewer can select the regimes that genuinely apply.

Which UK Regime Applies?

Is the practice consumer-facing?

Yes

CMA unfair commercial practices guidance applies

No

Do not casually extend consumer scope

The CMA's current unfair commercial practices guidance applies to consumer-facing commercial practices from 6 April 2025. It explains Part 4, Chapter 1 of the Digital Markets, Competition and Consumers Act 2024. Updated 18 November 2025, it covers misleading actions, misleading omissions and failure to identify commercial intent.

Regulator guidance, not a judicial ruling; its consumer scope should not be casually extended to a purely business transaction.

Paid or buyer-controlled content may also enter the CAP Code's remit. Section 2 addresses recognition of marketing communications, while Section 3 covers misleading advertising and substantiation. The Code is administered through the UK advertising self-regulatory system. It is not a substitute for legislation, and an editor's independent article is not automatically an advertisement merely because it began with supplied information.

Specialist sectors add their own checkpoints. The FCA says that financial promotions and adverts within its remit must be clear, fair and not misleading regardless of medium. A release about an investment, financial product or regulated firm should be routed to a named FCA-authorised or specialist legal reviewer before transmission. A distributor's category selector cannot make that assessment.

Keep evidence behind every objective claim

The claim file should connect each factual or objective statement to a dated primary record. Store the exact wording, source owner, version, geography, population, unit, limitations, approval name and expiry. A quoted statistic also needs its period and definition. If a qualification changes the overall impression, it belongs beside the claim rather than in a remote note.

Review omissions as seriously as positive statements. A fact can be literally correct yet leave out information material to a consumer decision. That is why the consumer, advertising and sector reviewers need to see the complete placement, headline, images, links and call to action, not only a clean text file.

Separate statement types in the copy desk:

  • observed fact:directly supported by the cited record;
  • attributed claim:clearly presented as another organisation's statement;
  • estimate or forecast:method, population, date and uncertainty shown;
  • opinion:speaker and factual basis identified;
  • unknown:retained as unknown, not repaired with confident prose.

No supplier's acceptance screen or distribution report substantiates the announcement itself. The buyer remains responsible for its authority and evidence even when another organisation performs transmission.

Decide when commercial identification is needed

Payment is important, but control and context also need examination. Record who paid, who commissioned the words, who approved them, whether a publisher could reject or alter them, where the material appears and what the audience is likely to understand. The advertising reviewer then records the applicable rule and the identification required for that specific presentation.

Do not describe paid placement as earned coverage. Conversely, do not attach an advertising label mechanically to independent journalism without reviewing the actual relationship. The safe operational rule is to reveal the facts to the reviewer, preserve the decision and stop publication when the commercial arrangement is unclear.

For consumer material, the CMA guidance notes commercial-intent and material-information issues. For controlled non-broadcast advertising, CAP Section 2 gives the relevant Code language. Sector-specific notices may be additional rather than interchangeable. The final label, prominence and placement need human review in context.

Map contact data before outreach

A media list is not simply a directory. For every personal contact, the buyer should record source, collection date, intended purpose, recipient or subscriber type, accuracy evidence, privacy information route, objection status, suppression key, retention and any onward supplier.

The ICO's business-to-business marketing guidance says publicly available personal data is not automatic agreement to direct marketing. It also distinguishes UK GDPR responsibilities from PECR rules for particular channels and subscribers. The ICO page carries a notice that it is under review following the Data (Use and Access) Act 2025.

The ICO's DUAA overview was updated on 19 June 2026 to state that all the Act's data-protection provisions are in force. It says the Act amends, rather than replaces, the UK GDPR, Data Protection Act 2018 and PECR. A privacy reviewer must use the current law and updated guidance, not an old workflow captured before commencement.

Editorial enquiry, service correspondence, event administration and marketing are different purposes. A journalist receiving one authorised release is not thereby subscribed to later promotion. Objections and corrections need an effective suppression process across the buyer and each relevant supplier, while necessary suppression data should be kept separate from a live outreach list.

Clear rights, confidence and sensitive content

The rights register should cover copy, quotations, photographs, video, charts, logos, music, datasets and third-party documents. The IPO's copyright ownership guidance explains that a creator is usually first owner and that commissioning work does not automatically transfer ownership without agreement. Record the owner, licence or assignment, territory, media, term, alteration right, credit and evidence.

Potentially defamatory allegations, confidential information, embargoes or disputed facts need a legal escalation lane, not a generic disclaimer. The Defamation Act 2013 principally extends to England and Wales, subject to specified exceptions. This article does not assess a defence, meaning or publication risk. Counsel should review the exact words, sources and circulation plan.

Market-sensitive information requires an issuer-specific process. A listed or regulated organisation should involve its company secretary, authorised disclosure committee and specialist counsel before external transmission. The distribution team should not decide whether information is inside information or whether a regulatory announcement is required. Its task is to preserve the approved version, time, destinations and any embargo instruction.

Treat accessibility and security as release gates

People may need HTML, accessible documents, captions, transcripts, audio, easy read or another format. Government accessible communication formats guidance, updated on 17 June 2026, provides practical public-sector advice and notes reasonable adjustments. A private organisation should use it as a planning reference, not as automatic proof of its own Equality Act position.

The release record names the intended audience need, format owner, test method, result and repair. A PDF that passed a spellcheck has not therefore passed an accessibility review. When an accessible version is required, a broken or absent alternative is a stop condition rather than a post-publication task.

Distribution systems can hold confidential drafts, personal contacts and account credentials. NCSC guidance on using SaaS securely covers access control, logging, recovery, data protection and incident planning. It does not certify any press-release platform. The security owner should test account recovery, least-privilege access, log availability, protected source copies and revocation before a real announcement is loaded.

Put supplier roles and corrections in writing

The commercial contract should identify the exact parties and distinguish content approval from technical handling. Define the service, endpoint vocabulary, evidence produced, charging unit, taxes, subcontractors, data instructions, intellectual-property permissions, security duties, incident notices, service changes, correction route, retention, export, deletion and exit.

Where a supplier processes personal data on a controller's behalf, the ICO's controller and processor contract guidance explains relevant UK GDPR arrangements. That page is also under DUAA review. A contract may allocate tasks, but it cannot create PECR permission, validate a marketing claim or erase a regulator's jurisdiction.

Correction powers vary by route. The buyer can amend its newsroom, request a contracted change, or give corrected facts to a publisher. It cannot silently rewrite independent editorial work. Define who notices an error, who can stop further transmission, who approves corrected text, how recipients are notified and what evidence closes the incident.

Use a non-compensating approval record

Do not average legal, advertising, privacy, rights, accessibility, security and sector decisions into one score. A strong security response cannot cure an unsupported medical claim. A clear advert label cannot create a copyright licence. A processor clause cannot override an objection to direct marketing.

The final record should contain:

  • authorised text and factual source pack;
  • route and commercial-control description;
  • recipient and personal-data journey;
  • rights and confidentiality register;
  • accessibility evidence;
  • security and recovery evidence;
  • supplier contract and correction process;
  • named decisions from each applicable specialist;
  • expiry, publication-day rechecks and stop authority.

Proceed applies only to the approved version, route, destinations and date. A material edit, changed payment arrangement, new recipient source, revised supplier terms, fresh regulator notice or security incident reopens the relevant gate.

This draft remains on publication hold. Before use, assign identifiable UK legal, advertising, regulated-sector, privacy and PECR, IP, accessibility, security, commercial and editorial reviewers. They must check the final announcement, its evidence, audience and delivery contract on the actual publication date. Distribution can move a file; it cannot supply endorsement, permission, truth or a lawful outcome.

Before you act

  • Name the exact communication activity before approving anything.
  • Record the legal entity, recipients, jurisdictions and any payment.
  • Route financial promotions to a named FCA-authorised or specialist reviewer.
  • Attach a dated primary record to every objective claim.
  • Log each contact's source, purpose, objection status and retention.
  • Escalate defamation, confidentiality and disputed facts to legal review.

Common questions

Does a delivery receipt prove that an announcement was read or trusted?

No. The article says a delivery receipt should stay a delivery receipt and must not be renamed coverage, reach or reputation. Indexing, reading, referral traffic and a commercial decision are separate events, each needing its own evidence before anyone treats them as an outcome.

When does paid or buyer-controlled content fall under the CAP Code?

The article says paid or buyer-controlled content may enter the CAP Code's remit. Section 2 addresses recognition of marketing communications and Section 3 covers misleading advertising and substantiation. An editor's independent article is not automatically an advertisement merely because it began with supplied information.

Can a supplier's distribution report substantiate the claims in a release?

No. The article states that no supplier's acceptance screen or distribution report substantiates the announcement itself. The buyer remains responsible for its authority and evidence even when another organisation performs the transmission, so the claim file must stand on dated primary records.
